ACER updates REMIT Q&As to reflect regulatory revisions

Notable changes include: new obligations for third-country market participants; order book reporting by organised marketplaces; and expansion of REMIT’s scope.

The Agency for the Cooperation of Energy Regulators (ACER) has released an updated version of its Questions & Answers (Q&As) on the Regulation on Wholesale Energy Market Integrity and Transparency (REMIT), aligning it with the recent amendments to the regulation. This update is crucial for market participants navigating the evolving landscape of the EU’s wholesale energy market.  

REMIT, established to prevent market abuse and foster fair competition, underwent revisions in 2024 to address the dynamic nature of the energy sector. ACER’s Q&A document, initially published in 2011, serves as a vital resource, summarizing frequently asked questions and providing clear, concise answers. The 30th edition of this document has been meticulously revised to reflect the changes introduced by the updated regulation.  

Key changes and clarifications

The updated Q&As focus on aligning legal references with the revised REMIT and clarifying critical concepts. Notable changes include:

  • New obligations for third-country market participants: The document provides detailed information on the new obligations imposed on market participants from third countries, ensuring they understand and comply with the updated regulatory framework.  
  • Order book reporting by organised marketplaces: Clarifications have been made regarding order book reporting requirements for organised marketplaces, streamlining reporting processes and promoting transparency.  
  • Expansion of REMIT’s scope: The Q&As address the expansion of REMIT’s scope to encompass new energy products, such as energy storage and hydrogen. This expansion reflects the evolving energy mix and ensures that emerging technologies are integrated into the regulatory framework.
