OCC will no longer examine for disparate impact

The banking regulator signaled that it will shift its focus to investigating overt discrimination.

The Office of the Comptroller of the Currency (OCC) announced that it will no longer consider “disparate impact” in the examination of banks’ fair lending practices, referring to the effects of policies that appear neutral but disproportionately disadvantage certain demographic groups.
